Terms of Service

By creating an account, purchasing a subscription, or using any feature of SmartResumeATS ("the Service"), you agree to be bound by these Terms of Service ("Terms") and our Privacy Policy.

If you are using SmartResumeATS on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.

If you do not agree to these Terms, do not use the Service.

SmartResumeATS provides an AI-powered resume building and ATS optimization platform, including but not limited to:

• Resume templates and a live resume builder

• AI-driven ATS match analysis against job descriptions

• Resume parsing and auto-fill from uploaded documents

• Resume PDF export and download

• Career resources and guides

Features available to you depend on your subscription plan (Free, Starter, or Pro). Plan details are outlined at smartresumeats.com/pricing and may be updated from time to time.

To access most features, you must create an account. You agree to:

• Provide accurate, current, and complete registration information

• Maintain the security of your password and not share your credentials

• Notify us immediately at support@smartresumeats.com if you suspect unauthorized access

• Take responsibility for all activities that occur under your account

We reserve the right to suspend or terminate accounts that violate these Terms, engage in fraudulent activity, or pose a security risk to other users.

Free Plan: Provided at no cost with usage limits as described on the pricing page. No credit card required.

Paid Plans (Starter / Pro): Billed monthly. Payment is processed via Razorpay and charged in the currency of your payment method. You authorize us to charge your payment method on a recurring monthly basis.

Cancellation: You may cancel at any time. Your paid plan remains active until the end of the current billing period. We do not prorate partial months.

Refunds: We offer a 7-day refund policy for first-time paid subscriptions. To request a refund, email support@smartresumeats.com within 7 days of your first payment. Subsequent renewals are non-refundable unless required by applicable law.

Price Changes: We will notify you at least 30 days before changing your subscription price. You may cancel before the new price takes effect.

You agree not to use SmartResumeATS to:

• Create, submit, or distribute false, misleading, or fraudulent resumes

• Impersonate another person or falsify qualifications on any resume

• Scrape, crawl, or systematically extract data from the platform

• Attempt to reverse-engineer, decompile, or copy our AI models or templates

• Transmit malware, spam, or unauthorized advertising

• Use the platform for any unlawful purpose under Indian or international law

• Circumvent usage limits (e.g., creating multiple accounts to bypass the free tier)

Violation of these terms may result in immediate account suspension and, where required, reporting to law enforcement.

Your Content: You retain full ownership of all resume content, work history, and personal data you enter into the platform. You grant us a limited, non-exclusive licence to process and store this data solely to provide the Service.

Our Content: The SmartResumeATS platform, templates, AI models, brand, and all associated intellectual property are owned by SmartResumeATS Technologies Pvt Ltd. You may not copy, redistribute, or create derivative works from our templates or platform without express written permission.

Feedback: If you submit feedback, suggestions, or feature ideas, you grant us the right to use them without restriction or compensation.

SmartResumeATS uses AI to generate resume suggestions, ATS analysis, and improvement recommendations. You acknowledge that:

• AI output is for guidance only and may not be accurate in all cases

• You are responsible for reviewing and verifying all AI-generated content before submitting it in any resume or job application

• SmartResumeATS does not guarantee employment outcomes, ATS scores from specific employer systems, or the accuracy of salary data

Always review AI suggestions critically and tailor them to your actual experience.

To the maximum extent permitted by applicable law:

• SmartResumeATS is provided "as is" without warranties of any kind

• We are not liable for any indirect, incidental, consequential, or punitive damages arising from your use of the Service

• Our total liability to you for any claim related to the Service is limited to the amount you paid us in the 3 months preceding the claim

Nothing in these Terms limits liability for fraud, death, or personal injury caused by our negligence.

By you: You may delete your account at any time from Account Settings. Account deletion is permanent and irreversible.

By us: We may suspend or terminate your account if you violate these Terms, abuse the platform, or for any other reason with 7 days' notice (or immediately if the violation poses risk to other users).

Effect of Termination: Upon termination, your right to access the Service ends immediately. Your resume data will be deleted within 30 days.

These Terms are governed by the laws of India. Any disputes arising from these Terms or your use of the Service shall be subject to the exclusive jurisdiction of the courts in Bengaluru, Karnataka.

Before initiating legal action, you agree to contact us at legal@smartresumeats.com to attempt good-faith resolution. Most issues can be resolved quickly by our support team.

We may update these Terms from time to time. When we make material changes, we will notify you by email at least 14 days before the changes take effect. Your continued use of the Service after the effective date constitutes acceptance of the revised Terms.
